Fundamental Procedures During Personal Injury Trials

There is a specialized civil trial called a personal injury trial. This determines liability, or legal responsibility, for an injury to a party. This is not a criminal trial; the determination of liability is not about punishing the liable party, but about compensating the injured party and awarding damages to them. There are several key steps in a personal injury trial.

First there will need to be a jury. The jury isn’t automatically appointed or random. The jury is chosen from a pool of randomly nominated people. Each person who is in this pool is questioned to make sure they will be an impartial judge. Anyone who has a conflict of interest or who may be biased will be left off of the jury.

Then after the jury is chosen and assembled, the attorneys make opening statements. These statements are where each side lays out a quick overview of what they will be arguing. The plaintiff presents their overview, and then the defendant reinterprets this viewpoint to suggest they are not at fault.

After opening statements comes testimony. In testimony, victims and witnesses present their story of what happened. They can tell about what they experienced, and also what they saw.

Cross-examination may occur. If this happens, the opposing counsel questions a witness and reviews their statements, with the goal of exposing inconsistency, bias, or untruthfulness.

Lastly comes closing arguments. This is the chance for each side to present an overview or wrap up of their arguments and the data supporting their arguments. It is the last component of the trial before the jury leaves to deliberate and vote.

Taken together, these steps are meant to give the jury all the information it needs to understand what happened in the case. Jury members are expected to impartially examine the available data, and to weigh the relative merits of each side’s arguments. Then the jury votes on which side made their case and whether the defendant is to be held liable.

When the jury has decided this they will then give their ruling to the court. In most states it has to be a unanimous decision with all jurors agreeing. In states that this is not required, there still must be an overwhelming majority, of 9 to 3 or better.

Save The Earth By Being More Environmentally Conscious

Admit it, you contributed to the current state of our environment. By current state, we mean dilapidated and abused to the core without guilt.

If you would say no, think of the paper that you decided not to recycle, the cigarette butts you throw on the streets and the amount of energy you have used up in your lifetime.

It is unlikely that you have lived the life of a caveman, in total respect for Earth, surviving off animal remains and raw vegetables. Although you have contributed to Earth’s slow death, you can begin doing your part to repair the destruction man has inflicted.

The simplest thing to begin with is saving electricity by unplugging your appliances when you’re not using them. Believe it or not, when appliances are left plugged in they remain in a standby mode and continue to consume electricity. Unplugging will save energy for the earth and save money for you.

Another thing to do is stop using those plastic straws. Did you ever wonder what happened to them once you had finished with them? They certainly are being put in anyone else’s drink. They go straight into the trash.

Perhaps the most effective method of going green is to live by the three Rs – reuse, reduce and recycle. Repurpose things like water bottles and newspaper, cut back on energy consumption by leaving fewer lights on and recycle items like paper and plastic. The thee Rs may be pass but they remain relevant and effective.

If you run an office, you can certainly recycle any paper products that are not needed anymore. Setting up a workplace policy will make this an effective measure.

There are still a lot of ways on how you can help Mother Nature heal and most of them are quite easy, actually. The trick here is to feel the effects of the climate change, the need for cleaner water and the responsibility to contribute to change.

Frank Bourne Hero of Rorkes Drift

The Battle of Rorkes Drift is without doubt one of the most famous battles during the background within the British army. It was around this little mission station along the border of Zululand and Natal where a few thousand Zulu warriors attacked a garrison of no more than 140 British soldiers. The soldiers fought for their lives through the night and by morning, the Zulu warriors had retired back to Zululand. The top award for gallantry while in the British Army is the Victoria Cross and the action at Rorkes Drift saw twelve VCs awarded, greater than in any other single action in the past.

The fight was portrayed in the Stanley Baker movie “Zulu” and one of several leading characters who acted heroically at Rorkes Drift, in the end didn’t get a Victoria Cross. Colour Sergeant Frank Bourne was instead awarded the Distinguished Conduct Medal that is ranked 2nd behind the Victoria Cross. In addition, Bourne was also offered a commission but he declined. Being the eighth son in their household, there was no money available and this was a time when wealth was used to buy commissions for officers within the British Army.

Of course, Bourne became a career soldier and a good one as well. Immediately following South Africa, he was posted to India and Burma before finally earning his commission 11 years on from the Battle of Rorkes Drift. He finally retired from the British Army in 1907. Only 7 years later, The First World War broke out and Bourne re-enlisted in the army. By the conclusion of the Great War in 1918, he had risen to the rank of Lieutenant-Colonel and was made an OBE. Bourne left the military again, this time around forever.

Because of the actor who played the part of Bourne in the film Zulu, the majority of people presumed Frank Bourne to have been middle aged during the time of the Battle of Rorkes Drift however in truth he was merely 24 years old.

After the finish of The First World War, Bourne lived in retirement in Beckenham, South London and he was the last survivor of the battle to pass away at the age of 91 on 8th May 1945, the very day World War II in Europe came to an end.

Even though he didn’t receive the Victoria Cross, CSM Frank Bourne was one of the most famous men who saw action at Rorkes Drift.

There are all kinds of arguments that can be made by anti-gay groups and individuals, but the truth of the matter is that gay couples pay into all of the systems nearly twice as much as heterosexual couples do.

There is no doubt that gay couples pay more in taxes when compared to the same income bracket hetero households. Without the ability to apply the usual benefits that married couples can apply, that het households with children can apply, and the basic filing options provided, taxes are simply a higher expense. Most couples end up paying about three quarters and change more than their straight counterparts.

It’s a great leap forward when companies voluntarily offer same sex partner benefits. Those benefits are, however, considered income and are taxed when the benefits of a married couple are not. Both partners have to supply medical coverage on their own. It can get pretty sticky when filing taxes if one partner paid for all or part of another’s health care.

Couples within the community have to spend more money in legal fees. If they want to ensure that their property is divided fairly or that their partner has sole custody of their child, gay couples have to seek legal services. To make sure that these documents are iron-clad, that means paying for legal services that are protected under marriage for straight couples.

Having children is automatically a higher expense for gay couples. The actual cost will depend on the method in which the couple may decide to go about getting pregnant. Most couples can spend anywhere from $30,000 to in excess of $75,000 just to get pregnant. The cost of additional medical care and actually raising the child is not included in that figure.

Even after gay couples have spent the better part of their lives together, have filed legal paperwork, and have gone through every available avenue, death benefits from the government and often death benefits from the employer of the deceased partner are denied. This can create additional financial hardships on families.

Children who are not biologically related to one parent will find that they can not expect their abilities to make medical decisions for their parent without appropriate paperwork. Likewise, the same can be said for minor children under the care of their non-biological parent. Second parent adoptions help to clear up these issues, but few states permit them. A non-biological parent can still be held accountable for the medical bills.

We have all heard all of the arguments that state that if we aren’t satisfied then we can change, or something like that. It’s quite interesting that while we are typically required to pay twice as much for life’s needs and wants, our money is perfectly acceptable. When it comes to enforcing those needs and wants, acceptable is not the word that comes to mind.

Why Public Records Are Not Free Online

You’ve probably heard the phrase “public records,” but do you know what it means? Generally speaking public records are those records that the public can access without restriction (mostly). The disclosure is because the records were made open voluntarily, or because some government transactions or archives require this to be the case. Most of these records have personal or even private information within.

Government agencies at all levels, from local through state and even federal, keep public records. All of these records are supposed to be free because they were disclosed for the purposes of public access.

To access public records, you go to the proper government agency. Then you simply put in a request for the record that you want, and wait for the response. The public record, if found, will be given or sent to you. You may be asked to pay a nominal fee for technical expenses.

Why do some online search sides charge you for access to these documents, then, if they are supposed to be free? There are several reasons.

One reason a site may ask you to pay is that they themselves purchased the documents from government agencies.

On some other sites, the document is free but the search service isn’t. It costs a good bit of money to maintain a huge, complex database for you to search.

People who need quick access to records but can’t pay should not be worried. You can also get online access to these records for free. Try to find the right sites to use by going to a search engine and searching for “public record access free sites.”

Some of these will be private websites that allow free searching, though often the database is smaller than are those that charge. You can also find websites that have links to government websites that allow online searching for records.

The Ancient History of Barry, South Wales: Part One

Much of what we know or have supposed about Barry and the Vale of Glamorgan, in which it is situated has been gleaned from the buildings found there, many of which have been badly neglected for too long. There are also legendary stories, such as that of Joseph of Arimathea, who traded tin in Glastonbury, just across the channel and who was one of the first missionaries to this part of the country.

Tradition maintains that the father of Caractacus took his son to Rome and was converted to Christianity. They returned to the Vale of Glamorgan with the missionary Bran the Blessed. We do know that Christianity had become fairly popular by the early 4th. Century and that south Wales sent some bishops to the Council of Rome.

One of the oldest shrines in the vicinity is St. Baruch’s Church on Barry Island, but it is also in very poor condition. Barry Island was one of the most important monastic retreats of the period in south Wales. Steep and Flat Holm islands in the Bristol Channel were also highly significant in this regard. Another very important part of the puzzle was St. Illtyd’s Seminary in Llantwit Major which had 2,200 students.

Porthkerry Point jutted out into the sea almost certainly further out than it is today and a castle was constructed there on the site of an ancient Roman fortress and naval dockyard. Many deer and wolf bones have been found between Barry and Sully, indicating the presence of these animals in great numbers. Arrowheads, flints, bone needles and coins have also been found.

Barry Island was first called ‘Baruch’s Island’, as far as we know, after Saint Baruch. St. Baruch had been found on one of the beeches, washed up dead in 700 AD. He is known to have drowned when returning from Flat Holm, which was commonly used as a retreat by religious people over Lent.

He and Gwelches were both students of St. Cadoc and when they had got back from Flat Holm, they realized that they had left their enchiridion (religious manual) behind. St. Cadoc made them go back for it. Neither monk returned from the trip alive.St. Illtyd, St. Baruch’s most famous disciple was educated there too.

Barry Island has had several names, including Island of the Saints and Insular of Peiros. St. Peiro was the leader of the seminary after St. Illtyd and the mentor of St. Samson. St. Doeninas was also a leader of another abbey near Friars Point on the island.

Dogs And Temporary Kennels

Are you the sort of dog owner who likes to take your companion with you wherever you go? If you are then you know that that there are times when you can do this, but there are also times when you can not, for whatever reason.

On the occasions when that happens, you will usually have to to find a boarding kennels that will take care of your dog while you are away.

A vacation is a time for relaxing, so you do not want to be worrying about your dog, if you can help it. Within your own country, it is not usually a big problem, but if you go abroad, then taking your dog can be more trouble than it is worth. Not only for you, but for your doggy friend as well.

If you can not place your dog with someone it knows, like a member of your family or a neighbour, then the only option is a boarding kennels.

I have put my dog in a bad kennel once and I learned a few lessons from that. I put my Becky in a kennel in a highly regarded village just outside our town. I was happy with what I saw and the sales pitch of the owner, so I went to Spain, thinking that all was fine for both of us. I had a great holiday and went straight to the kennels from the airport on my return, although I had told them a fortnight before that I would pick Becky up the day after my arrival. I just could not wait to see her.

I went to the kennels and they were surprised to see me. Of course, I was a day early. They said that Becky was ‘resting’ and that it would be better to ‘come back tomorrow’. No way! So they took me to see her. I nearly cried. She was sitting in a good sized cage, but on newspaper sodden with pee.

She saw me and just looked down at her paws. I called her name again, but she did not want to know. I paid the bill and put her in the car on the front passenger seat where she always sat. She just looked out the window and showed no interest in me whatsoever.

It was three days before she would speak to me again! The moral of this story is not to be impressed by big adverts or impressive locations as I was. Ask your dog-owning friends, write into the local paper inviting recommendations, phone the local animal protection society or the kennel club or look on the Internet.

Understanding The Meaning Of “Power Of Attorney”

This can be good and bad depending on each individual case.

The general power of attorney gives the agent all the freedom to carry out any of your affairs while the limited one will only allow them liberty to do only that which you have specified in the document.

There is also a durable power of attorney as well which is the opposite of the ordinary power of attorney. The ordinary power of attorney expires if something should render you unable to decide on your own affairs what should and should not be done.

The durable power of attorney however remains capable of exercising your powers even when you are rendered incapable of handling your own affairs by an illness, injury or in case of death.

If you have a large amount of affairs to be handled then a power of attorney always comes in handy in making sure that only good decisions that are in your best interest are made for your affairs. Bow fishing is a skillful sport, but the equipment need not necessarily be hi-tech. The fact is that you can use whatever bow you have or you can just make one. It does not have to be strong, because the quarry is seldom more than ten feet away. You categorically do not need a 100 lbf longbow to kill a trout.

Having said that, any bow used for fishing will need to be adapted slightly – you will need to attach a reel to it, but it does not have to be anything fancy. There are three principal types of reel for use in bow fishing: hand-wrap, spincast and retriever and the line is usually braided nylon of approximately eighty pounds although you might require six hundred pound breaking strain line for alligators or sharks.

It is worth checking out the regulations with regard to bow fishing in your country or state, because sometimes bow fishermen have to be licensed and sometimes getting that license involves having been on a safety course.

Some regions will even have regulations concerning the type of equipment you can use in bow fishing and of course, some fish have seasonal limitations.

Bow fishing is a hybrid of fishing and hunting, so you could have to acquire some new skills like tying knots for instance. You will have to be able to tie the line to the reel and the arrow and those knots will have to be able to put up with the tremendous acceleration that an arrow leaving a bow goes through without failing.

The arrows do not have fletching either because flights are apt to avert the true course of the arrow in water – the opposite of in the air.

There are three main techniques used in bow fishing: 1] you can put down ground bait and lie in wait. – an over hanging tree or high rock is good for this; 2] you can float down stream in a dinghy while sitting or standing in the prow; 3] you can walk into the river like a salmon fisherman.

Compensating for the refraction of the water is the most difficult ability to learn and that means knowing the water well as well.
